Rights-holders who become IVARO members are joining an association that works to protect their intellectual property rights and ensures that they are properly compensated for the reproduction or resale of their work.

The work of IVARO falls into three main sections:

Firstly, it sells licences, which allow users to reproduce copyright material;

Secondly, in relation to the Artists Resale Right, it collects the revenue on behalf of entitled members from art market professionals such as galleries, auction houses and art dealers.

Thirdly, it distributes royalties to and the revenue collected for the creators whose works have been reproduced or resold, after deduction of administrative costs.

Reproduction Rights

Primary Licensing (IVARO members only)

IVARO acts as an intermediate between copyright holders and copyright users to negotiate licenses, which allow for the reproduction of artists work. This is done on a case-by-case basis with the involvement of the copyright holder.  IVARO’s role is to facilitate the negotiation and ensure appropriate terms and conditions for copyright holders.

Reprography

Collective licensing (all visual creators)

IVARO has an agreement with the Irish Copyright Licensning Agency (ICLA) under which ICLA pays IVARO a percentage of its gross income. In return IVARO mandates ICLA to include copying (photocopying) of visual works in the licences it sells to schools, universities and businesses. In 2010 IVARO will develop a process and procedure through which, artists will be able to claim back the money collected through the sale of these licenses. The revenue is collected and distributed to rights holders once a year.

Artists Resale Right

(IVARO members only)

In Ireland only resales of art at or above a threshold of €3,000 qualify for resale royalties. The royalty rate starts at 4%, descending to .25%.

IVARO is collecting and distributing the artist’s resale right on behalf of members.  IVARO will continue to monitor auctions and sales of Irish art and on behalf of mandated artists we will request information and payments from art market professionals regarding sales of their work.  We distribute 85% of the sums collected back to the appropriate artists.

Reciprocal Rights Agreements with foreign collecting societies

IVARO continues to negotiate and establish bilateral agreements with international visual artists collecting societies. Through these reciprocal rights agreements, IVARO can collect for Irish artists royalties due to them for reproduction of their works in other countries. A reciprocal agreement is in place with DACS in the UK regarding the resale right only.

  • Providing press releases to the media on relevant issues affecting artists
  • Education of our own members

Advocating to Government

IVARO continues to make submissions on the forthcoming Intellectual Property Bill to the Department of Tourism, Culture & Sport and the Department of Enterprise, Trade and Innovation and meeting with the respective Ministers to represent the rights of artists. In particular this will focus on the elements of the artists resale right legislation which have not yet been fixed such as the threshold; rights of heirs; compulsory collective management; and better right to information for artists.

Maintaining presence in press and media

Writing and placing articles concerning the artists resale right in relevant newspapers and journals supporting the artists position and to counter any opposition.

Representing artists in negotiations

Meeting with representatives of the Irish Auctioneers and Valuers Institute (IAVI) and relevant galleries and art dealers to discuss methods of best practice for collection of resale royalties.

Representing interests of Irish artists at international level

IVARO participates at conferences and working group meetings held internationally to promote the concerns of Irish visual creators and to work on their behalf. We are members of CISAC and EVA – the umbrella bodies for copyright collecting societies.
